§1 Scope of application

The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order. A consumer is any natural person who enters into a legal transaction for purposes which can predominantly be attributed neither to his commercial nor to his independent professional activity (§ 13 BGB).

 

§2 Conclusion of a contract, storage of the text of the contract

(1) The following regulations on the conclusion of a contract apply to orders placed via our internet shop https://shop.klosterbraeu.com.

(2) In the event of the conclusion of a contract, the contract is concluded with

shall be concluded.

(3) The presentation of the goods in our Internet shop does not constitute a legally binding offer of contract on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) Upon receipt of an order in our Internet shop, the following regulations shall apply: The consumer makes a binding offer to enter into a contract by successfully completing the order procedure provided in our Internet shop.

The order is placed in the following steps:

Selection of the desired goods
Confirmation by clicking the "Order" button
Checking the details in the shopping basket
Pressing the "checkout" button
If applicable, logging into the Internet shop after registering and entering the login details (e-mail address and password).
Check again or correct the data entered.
Binding submission of the order by clicking the button "order with costs" or "buy".
Before the binding submission of the order, the consumer can return to the Internet page on which the customer's details are recorded and correct input errors by pressing the "Back" button contained in the Internet browser used by him after checking his details or can cancel the order process by closing the Internet browser. We confirm receipt of the order immediately by an automatically generated e-mail ("order confirmation"). With this we accept your offer.

(5) Storage of the contract text for orders via our Internet shop: We store the text of the contract and send you the order data by e-mail. You can view the General Terms and Conditions at any time at https://www.klosterbraeu.com/agb. You can view your past orders in our customer area under My Account/My Orders.

(6) Only persons over the age of 18 are entitled to purchase in our Internet shop.

 

§3 Products

(1) The essential characteristics of the products result from the respective product description.

(2) Deviations in pictures are possible. Errors and changes to the articles are excepted.

(3) In the event of insufficient availability or non-availability of an item, we shall endeavour to make a subsequent delivery within 14 days.

(4) If there is a defect in the purchased item, the statutory provisions shall apply. Deviating from this, for items that have not been used properly, the warranty period for new goods is two years from delivery to the customer.

 

§4 Vouchers

(1) Vouchers cannot be redeemed in cash. If the consumption is less than the value of the voucher, we will issue another credit note.

(2) The voucher is valid when the amount due has been paid in full.

(3) The invoice with proof of tax can only be issued at the time of the actual provision of the service, i.e. the redemption of the voucher.

(4) We accept no liability for late delivery by post.

(5) In the event of loss, theft or cancellation of vouchers, no compensation will be provided by Hotel Klosterbräu Seyrling GmbH.

§5 Prices, shipping costs, payment, due date

(1) The prices quoted include the statutory value added tax and other price components. Shipping costs, if any, shall be added.

(2) The consumer has the option of payment in advance and credit card (Visa, Mastercard).

(3) If the consumer has chosen payment in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.

 

§6 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. In this case, delivery shall take place within 7 working days at the latest. In the case of payment in advance, the delivery period shall commence on the day after the payment order to the bank commissioned with the transfer and, in the case of all other payment methods, on the day after the conclusion of the contract. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the sold item shall not pass to the buyer until the item has been handed over to the buyer, even in the case of a mail order purchase.

 

§7 Exchange and return

(1) Please return products to us within 14 days of receipt. It is sufficient if the written declaration of withdrawal or cancellation is sent within 14 days. However, the right of withdrawal does not apply if the claim or use is started within the withdrawal period. This right of withdrawal applies to consumers within the meaning of the Consumer Protection Act.

(2) In order to exercise your right of withdrawal, you must send us

by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to revoke this contract.

(3) If you withdraw from the contract, we must refund all payments we have received from you without delay and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

(4) The cost of returning the goods shall remain with the buyer.

(5) Products that are exchanged or returned must be in their original packaging and free of signs of use and proof of use.

 

§8 Retention of title

We retain title to the goods until the purchase price has been paid in full.

§9 Warranty

The statutory warranty regulations apply.

§10 Contract language

Contract language is German.

 

§11 Place of jurisdiction

Seefeld in Tyrol.
